SSA Section 76 — Old-age benefit
Social Security Act (พระราชบัญญัติประกันสังคม) — Section 76.
Plain-English Summary
Eligibility requires contributions paid for at least 180 months, consecutive or not. The benefit is a monthly pension or a lump sum, with rules and rates set by ministerial regulation (Section 77). With at least 180 months the pension starts from the month after the insured reaches 55, or, if still insured at 55, from the month after insured status ends; with fewer than 180 months and insured status ended the benefit is a lump sum. A non-Thai insured whose status has ended and who does not wish to remain in Thailand may take a lump sum whatever the months paid (Section 77 bis). If a pension recipient dies within 60 months of the month of entitlement, heirs receive a lump sum (Section 77 quater).

Social Security Act
พระราชบัญญัติประกันสังคม · B.E. 2533 (1990)
The Social Security Act B.E. 2533 (1990) established the Social Security Fund within the Social Security Office (Section 21). The Fund pays benefits to insured persons for illness or injury, childbirth, invalidity, death, child allowance, old age and unemployment (Section 54). Employees aged 15 to 60 are insured compulsorily (Section 33), and former employees and other persons may join voluntarily (Sections 39 and 40). For compulsory insureds the Government, employers and insured persons contribute (Section 46); voluntary Section 39 insureds pay with the Government at a ratio of two parts to one, and the Government's share for Section 40 insureds is capped at half of what they pay. The contribution rates, the wage base and most benefit amounts are set by ministerial regulation or Royal Decree, not in the body of the Act; the Act's annex fixes only maximum contribution rates.
