SSA Section 40 — Other persons who apply to be insured
Social Security Act (พระราชบัญญัติประกันสังคม) — Section 40.
Plain-English Summary
A person who is not a Section 33 employee, or is outside the Act, may apply to be insured by declaring intent to the Office. The qualifications of such persons, the contribution rules and rates, the benefit types under Section 54 and the conditions for entitlement are set by Royal Decree. The Government contributes at a rate set by ministerial regulation but not above half of what it receives from these insureds. The Act body states no baht amount.

Social Security Act
พระราชบัญญัติประกันสังคม · B.E. 2533 (1990)
The Social Security Act B.E. 2533 (1990) established the Social Security Fund within the Social Security Office (Section 21). The Fund pays benefits to insured persons for illness or injury, childbirth, invalidity, death, child allowance, old age and unemployment (Section 54). Employees aged 15 to 60 are insured compulsorily (Section 33), and former employees and other persons may join voluntarily (Sections 39 and 40). For compulsory insureds the Government, employers and insured persons contribute (Section 46); voluntary Section 39 insureds pay with the Government at a ratio of two parts to one, and the Government's share for Section 40 insureds is capped at half of what they pay. The contribution rates, the wage base and most benefit amounts are set by ministerial regulation or Royal Decree, not in the body of the Act; the Act's annex fixes only maximum contribution rates.
