Court Procedure in Thailand
How civil and criminal cases proceed through Thai courts—from filing to judgment and enforcement, including evidence rules and hearing procedures.
Overview
Thai court procedure is governed primarily by the Civil Procedure Code (for civil matters) and Criminal Procedure Code (for criminal matters). While Thailand follows a civil law tradition, its procedural rules share some similarities with both civil and common law systems.
Cases are heard by professional judges (not juries), with the court playing an active role in investigating facts alongside the parties' submissions. Understanding procedural requirements is essential for anyone involved in Thai litigation.
Civil Procedure
Civil cases involve disputes between private parties over rights, obligations, or compensation:
1. Filing the Complaint
Plaintiff files a written complaint (คำฟ้อง) with the appropriate court, paying court fees. The complaint must state the facts, legal basis, and relief sought.
2. Service of Process
Court serves the complaint on the defendant, who has 15 days (or more if abroad) to file an answer or counterclaim.
3. Answer & Pleadings
Defendant files answer (คำให้การ) admitting or denying allegations. May also file counterclaims or cross-claims. Reply to counterclaim may follow.
4. Pre-Trial Conference
Court holds conference to identify issues, encourage settlement, and schedule trial dates. Mediation may be attempted.
5. Trial
Parties present evidence and witnesses. Plaintiff's case first, then defendant's. Each witness examined, cross-examined, and re-examined.
6. Judgment
Court issues written judgment with findings of fact and law. May award damages, specific performance, or other relief.
7. Appeal
Losing party may appeal to Court of Appeal within 30 days, then to Supreme Court on points of law.
Criminal Procedure
Criminal cases involve prosecution by the state for violations of criminal law:
1. Investigation
Police investigate the alleged offence, collect evidence, and prepare a case file. Suspects may be questioned and arrested.
2. Arrest & Detention
Arrest with or without warrant. Initial detention up to 48 hours, extendable with court order. Bail may be requested.
3. Prosecution Decision
Case file sent to public prosecutor who decides whether to charge. May request further investigation or decline prosecution.
4. Indictment
Prosecutor files indictment (คำฟ้อง) with court. Accused is formally charged and enters plea at arraignment.
5. Trial
Prosecution presents case first, then defence. Accused has right to remain silent. Evidence and witnesses examined.
6. Verdict & Sentencing
Court delivers verdict (guilty or not guilty). If guilty, proceeds to sentencing considering aggravating and mitigating factors.
7. Appeal
Either party may appeal conviction or sentence to Court of Appeal, then Supreme Court.

Hearing Procedures
Court Sessions
Courts typically sit from 9:00 AM to 4:00 PM with a lunch break. Cases are scheduled in sessions, and multiple hearings may be needed to complete a trial. Punctuality is essential.
Language Requirements
All proceedings are conducted in Thai. Non-Thai speakers have the right to an interpreter. Foreign language documents must be translated and certified.
Representation
Parties may represent themselves or be represented by Thai-licensed lawyers. Corporate entities must be represented by counsel. Powers of attorney are required for representatives.
Court Etiquette
Formal dress is required (business attire). Rise when judges enter/exit. Address judges respectfully. No photography or recording without permission. Mobile phones must be silenced.

Judgments are issued in writing, stating the court's findings of fact, application of law, and the order or relief granted. Reasons must be provided. Judgments are typically read in open court on a scheduled date.
Types of Relief
Courts may order monetary damages, specific performance, injunctions, declaratory relief, or other appropriate remedies. In criminal cases, penalties include imprisonment, fines, forfeiture, probation, or acquittal.
Enforcement
Civil judgments are enforced through execution procedures including asset seizure, bank account garnishment, and property foreclosure. Enforcement officers (จ่าศาล) execute court orders. Contempt proceedings are available for non-compliance.
