Making or Registering a Will as a Foreigner in Thailand

Document Checklist
Decide between a Thai Will, home country Will, or both
A Thai Will covers Thai assets. A home country Will covers foreign assets. Estate lawyers recommend separate Wills for Thai and overseas assets.
Identify all assets in Thailand (property, bank accounts, vehicles, shares)
Create a complete inventory. Property ownership for foreigners is restricted — your Will must reflect what you legally own.
Choose the form of Will (Holographic, Witnessed, or Registered)
Holographic: entirely handwritten, no witnesses. Witnessed: typed, requires 2 witnesses. Registered: made before a District Officer — most secure.
Choose two witnesses who are NOT beneficiaries
Witnesses must be adults of sound mind and NOT named as beneficiaries. Spouses of beneficiaries should also be avoided.
Witnesses must sign in the presence of the testator and each other
Thai law requires simultaneous witnessing — witnesses cannot sign at different times.
Draft the Will in Thai (or bilingual Thai/English)
Thai courts use the Thai version as primary. Have a certified translator prepare the Thai version.
For Registered Will: appointment at local Amphur (District Office)
The District Officer witnesses and registers the Will. Provides maximum legal certainty.
Name an executor who can act in Thailand
The executor handles the estate. If no one in Thailand, consider appointing a Thai lawyer.
Store the Will securely and tell family where it is
Common options: with your lawyer, in a bank safe deposit box, or registered at the Amphur.
Common Mistakes to Avoid
Using a beneficiary as a witness — this invalidates that beneficiary's inheritance under the Will.
Making a Will only in English — Thai courts default to the Thai version.
Assuming a home country Will covers Thai property — Thai courts apply Thai succession law.
Forgetting to appoint an executor — without one, the court appoints an administrator which takes time.

The Amphur registration process is inexpensive (around THB 200-400) and provides strong legal protection.
Keep a letter of instructions alongside your Will describing funeral arrangements and digital accounts.
If you have children from a previous relationship, be specific about inheritance to avoid disputes.
