Definition
Selling or supplying cannabis outside the current controlled-herb rules — for example selling flower without the required licence/registration, to minors, or for recreational use — can breach the Traditional Medicine Knowledge Act notifications and, for high-THC extracts, the Narcotics Code. Under Thai law, this offence is classified as a serious offence within the category of Cannabis & Hemp Law.
Legal Basis
Protection and Promotion of Thai Traditional Medicine Knowledge Act B.E. 2542 (1999)
Primary legislative provision for unlicensed sale or supply of cannabis offences.
Narcotics Code B.E. 2564 (2021) (extracts above 0.2% THC)
Primary legislative provision for unlicensed sale or supply of cannabis offences.
Elements of the Offence
For a conviction, the prosecution must prove all of the following elements beyond reasonable doubt:
Selling, supplying or possessing cannabis outside the permitted controlled-herb conditions
Or dealing in an extract exceeding the 0.2% THC narcotic threshold without authorisation
Penalties
Maximum Penalty
Fines and/or imprisonment depending on the instrument breached; narcotic extracts carry heavier penalties
Actual sentences depend on factors including the severity of the conduct, harm caused, prior convictions, and mitigating circumstances. Courts have discretion to impose lesser sentences within the statutory range.
Possible Defences
The following defences may be available depending on the circumstances:
Holding the correct licence/registration and complying with the current notifications
The product is a permitted part or preparation within the allowed THC limit
Note: The availability of defences depends on specific facts. Professional legal advice is essential.
For Foreigners
Special Considerations for Foreign Nationals
Foreigners face the same rules and feature heavily in enforcement against tourist-facing dispensaries. Rules change quickly; a shop that was compliant last year may not be now. Never carry cannabis across a border — that is a separate, serious offence.
When Legal Representation Matters
If you are accused of unlicensed sale or supply of cannabis or facing investigation, immediate legal representation is essential to protect your rights and build an effective defence.
