Why Foreigners Need a Thai Will

If you own assets in Thailand — a condo, bank accounts, a vehicle, or business shares — you should have a Will that specifically covers these assets.

Important: A foreign Will may not reliably cover Thai property. Thai courts apply Thai succession law to assets located in Thailand.

Witness Requirements

Critical rules:

Must have 2 witnesses (for witnessed/registered Wills)

Witnesses must be adults of sound mind

Witnesses cannot be beneficiaries

Witnesses cannot be spouses of beneficiaries

Both witnesses must sign in presence of testator and each other

Using a beneficiary as witness invalidates their inheritance.
