    Definition

Not stopping, helping and reporting after a road accident that injures a person or damages property. Under Thai law, this offence is classified as a serious offence within the category of traffic.

    Elements of the Offence

For a conviction, the prosecution must prove all of the following elements beyond reasonable doubt:

    1

Being the driver in a road accident causing injury or property damage

    2

Failing to stop, give reasonable assistance, identify oneself and report to the nearest police

    Penalties

    Maximum Penalty

Up to 3 months imprisonment and/or a fine of THB 2,000–10,000, rising to up to 6 months and/or THB 5,000–20,000 where the accident causes serious injury or death. The vehicle may be seized and, if the owner does not come forward within six months, forfeited to the State.

Actual sentences depend on factors including the severity of the conduct, harm caused, prior convictions, and mitigating circumstances. Courts have discretion to impose lesser sentences within the statutory range.

    Possible Defences

The following defences may be available depending on the circumstances:

Genuinely unaware that an accident occurred

Did stop, assist and provide the required details

Note: The availability of defences depends on specific facts. Professional legal advice is essential.

    For Foreigners

    Special Considerations for Foreign Nationals

Fleeing triggers a statutory presumption of guilt and seizure of the vehicle, compounding any underlying charge and jeopardising insurance cover and visa status.

    When Legal Representation Matters

If you are accused of failing to stop after an accident (hit-and-run) or facing investigation, immediate legal representation is essential to protect your rights and build an effective defence.
