When to Use
Before marriage registration at the Amphur. A Thai prenuptial agreement must be made before and registered together with the marriage — post-nuptial agreements are not recognized under Thai law.

Identification of Sin Suan Tua (Personal Property)
List all personal property each party brings into the marriage — property owned before marriage remains personal.
Sin Somros (Marital Property) Management
Define how community property acquired during marriage will be managed and divided if divorced.
Income and Earnings Classification
Specify whether income earned during marriage is personal or community property.
Debt Allocation
Clarify which debts are personal and which are joint — pre-marriage debts typically remain personal.
Property Division on Divorce
Specify the percentage split of community property on divorce (default is 50/50).

Warnings
A prenuptial agreement MUST be registered at the Amphur together with the marriage registration — otherwise it is void.
Post-nuptial agreements (after marriage) are NOT recognized under Thai law.
Both parties should have independent legal advice — one-sided agreements may be challenged.
Clauses relating to child custody or child support cannot be pre-determined and will not be enforced.
The agreement must be in Thai to be registered — bilingual versions are recommended.
