When to Use
When you need someone to act on your behalf for legal, financial, or administrative matters in Thailand — especially useful for property transactions, court appearances, and bank matters when you cannot be present.
Key Clauses
Principal and Attorney Identification
Full identification of both the principal (grantor) and attorney (agent) with passport/ID numbers.
Scope of Authority
Precisely define what acts the attorney is authorized to perform — specific powers are safer than general.
Duration and Expiry
Set a clear expiry date or triggering event. Avoid open-ended powers of attorney.
Revocation Terms
Include clear procedures for revoking the power of attorney.
Sub-delegation Restriction
Specify whether the attorney can delegate authority to a third party (usually not recommended).
Notarization and Legalization
State the authentication requirements — Thai authorities often require embassy legalization.
Warnings
A general power of attorney gives extremely broad authority — use SPECIFIC powers of attorney whenever possible.
Powers of attorney executed abroad must be notarized and legalized (embassy + MFA) to be valid in Thailand.
Land Office transactions require a SPECIFIC power of attorney — general POAs are not accepted.
A power of attorney is automatically revoked on the death of either the principal or attorney.
