Medical Power of Attorney / Healthcare Directive

Designate someone to make medical decisions on your behalf if you become incapacitated in Thailand.

    Updated:
Legal Basis: Civil and Commercial Code (Power of Attorney provisions); Medical Council Ethics GuidelinesEst. Cost: THB 5,000–15,000 for lawyer-drafted document with notarization

    When to Use

For foreigners living in Thailand who want to ensure their medical wishes are respected if they become unable to communicate — especially important for retirees and those with chronic conditions.

    Key Clauses

    Agent Designation

    essential

Name the person authorized to make medical decisions. Include backup agent if primary is unavailable.

    Scope of Authority

    essential

Specify which decisions the agent can make: treatment consent, hospital choice, medication decisions, surgery consent.

    Treatment Preferences

    recommended

State preferences regarding life-sustaining treatment, pain management, and organ donation.

    Activation Trigger

    essential

Specify when the POA takes effect: upon two physicians certifying incapacity.

    Revocation

    recommended

Can be revoked at any time by the principal while competent. Revocation should be in writing and communicated to hospitals and agent.

    Warnings

Thailand does not have a specific 'living will' law — medical POA is the closest equivalent.

Thai hospitals may not recognize foreign advance directives — create a Thai-language version.

Ensure your designated agent can be reached in Thailand and speaks Thai or has an interpreter.

Carry a card in your wallet stating you have a medical POA and where it's stored.

    Professional Legal Assistance

When a matter involves investigation, arrest, detention, litigation, or regulatory action, professional legal representation becomes essential.
