Debt Settlement Agreement

When to Use
When you owe money and want to negotiate a reduced or restructured payment plan, or when you're owed money and want to formalize a settlement.
Key Clauses
Acknowledgment of Debt
Debtor acknowledges the original debt amount. This prevents future disputes about the existence or size of the debt.
Settlement Amount & Terms
Agreed reduced amount, payment schedule (lump sum or installments), and payment method.
Full and Final Settlement
Clear statement that upon payment of the agreed amount, the creditor releases all claims and the debt is fully discharged.
Default Provisions
What happens if the debtor misses a payment — typically the full original amount becomes due again.
Confidentiality
Both parties agree not to disclose the terms of the settlement.
Warnings
Without the 'full and final settlement' clause, the creditor may pursue the remaining balance later.
Oral settlement agreements are difficult to enforce — always put it in writing.
If the debt involves a court judgment, the settlement should be filed with the court.
