    Affidavit Template (Thai Court Format)

    A sworn affidavit (คำให้การเป็นลายลักษณ์อักษร) template formatted for use in Thai courts or as a notarised statement for embassy and government purposes. Must be sworn before a Notarial Services Attorney (NSA) or court official under the Notarial Services Attorney Act B.E. 2546 (2003).

    When to Use

    When providing written evidence in Thai civil or criminal proceedings, for embassy authentication of identity or status, or for cross-border legal matters where a sworn statement is required.

    Key Clauses

    Title and Court/Authority

    If for a court: full court name and case number. If for embassy: name of receiving authority.

    Deponent Identification

    Full passport name, nationality, passport number, address, occupation, age. Identification must match a current government-issued ID.

    Oath or Affirmation Clause

    Standard wording: 'I, [name], do solemnly swear/affirm that the contents of this affidavit are true and correct to the best of my knowledge and belief.'

    Numbered Statements of Fact

    Each material fact in a separate numbered paragraph. Be specific — dates, names, amounts, locations.

    Reference to Exhibits

    If documents are attached, label them Exhibit A, B, C... and reference them in the body ('See Exhibit A').

    Statement of Knowledge

    Indicate whether statements are made from personal knowledge, belief based on documents, or hearsay (and identify the source).

    Signature Block

    Deponent's signature, date, and place of signing.

    Notarial Certification Block

    NSA's signature, stamp, registration number, and statement that the deponent appeared and was identified.

    MFA Legalisation (If Going Abroad)

    recommended

    For use overseas, the notarised affidavit typically needs Ministry of Foreign Affairs (กระทรวงการต่างประเทศ, MFA) legalisation and possibly receiving-country embassy legalisation. Thailand is NOT a party to the Apostille Convention as of 2026.

    Warnings

    False statements in an affidavit are an offence under Penal Code Section 177 (perjury): up to 5 years imprisonment.

    Only attorneys licensed as Notarial Services Attorneys under the Notarial Services Attorney Act B.E. 2546 (2003) may notarise — verify your attorney's NSA registration with the Lawyers Council of Thailand (สภาทนายความ).

    Affidavits in Thai courts must be in Thai or accompanied by a certified Thai translation under Section 46 of the Civil Procedure Code.

    For use in countries that are parties to the Apostille Convention, Thai documents require full chain legalisation (NSA → MFA → receiving embassy) — apostille is NOT available from Thai authorities as of 2026.
