Adoption Consent Agreement

When to Use
When biological parents are consenting to the adoption of their child, either domestically or as part of an intercountry adoption process through DSDW. This agreement is a critical legal document required by Thai courts.
Key Clauses
Biological Parent Details
Full legal names, ID/passport numbers, addresses, and nationalities of the biological parent(s). If one parent is deceased or has had rights terminated, include the relevant court order.
Adopter Details
Full legal names, ID/passport numbers, addresses, nationalities, and ages of the prospective adoptive parent(s). Include marriage certificate details if a married couple.
Child Details
Full name, date of birth, place of birth, nationality, and birth certificate details of the child to be adopted.
Consent Declaration
Clear, unambiguous statement that the biological parent(s) freely and voluntarily consent to the adoption of the child by the named adopter(s). Must state consent is given without coercion, fraud, or inducement.
Understanding of Rights Termination
Acknowledgment that upon completion of the adoption, the biological parent's legal rights and responsibilities regarding the child will be permanently terminated under the Civil and Commercial Code.
Witness Signatures
At least two witnesses must sign the consent agreement. Witnesses must be adults of sound mind who are not parties to the adoption.
Notarization Clause
Provision for notarization of the consent agreement. For intercountry adoptions, the document may need to be legalized by the Thai MFA and/or apostilled.
Warnings
Consent cannot be given for a child under 15 days old — the biological mother must have time to consider her decision.
Consent can be revoked before the court issues the adoption order — once the court order is final, consent is irrevocable.
If the child is over 15 years old, the child's own consent is also required.
Both biological parents must consent unless one parent's rights have been legally terminated.
Consent obtained through fraud, coercion, or payment (other than lawful expenses) is void and may result in criminal charges.
For intercountry adoption, the consent must comply with both Thai law and the Hague Convention requirements.
