Your Rights After a Motorcycle Accident in Thailand
Know your legal rights after a motorcycle accident — insurance claims, liability, and medical treatment.
Your Rights
Right to emergency medical treatment
Legal Basis: National Health Security Act; Emergency Medical Act
What To Do: Call 1669 for ambulance. ALL hospitals must provide emergency treatment regardless of ability to pay.
Right to a police report
Legal Basis: Criminal Procedure Code
What To Do: Insist on a police report. You need it for insurance claims. Call 191 or Tourist Police 1155.
Right to insurance compensation
Legal Basis: Compulsory Motor Vehicle Insurance Act
What To Do: ALL vehicles must have Por Ror Bor insurance. Even if the OTHER driver is at fault, their insurance covers your injuries.
Right to not be detained at hospital for inability to pay
Legal Basis: Criminal Code (illegal detention); Medical ethics regulations
What To Do: Hospitals cannot hold you hostage for unpaid bills. If threatened, call Tourist Police 1155.
Right to compensation from the at-fault party
Legal Basis: Civil and Commercial Code, Sections 420-437 (Torts)
What To Do: The at-fault party is liable for medical bills, lost income, vehicle damage, and pain/suffering.
Common Myths vs Reality
Myth: No helmet = no rights
Reality: Not wearing a helmet may reduce your compensation but does NOT eliminate your right to claim against the at-fault party.
Myth: Foreigners are always blamed in accidents
Reality: Fault is determined by evidence. A dashcam and police report protect you. Insist on proper documentation.
