Right to marriage equality
Legal Basis: Marriage Equality Act B.E. 2567 (2024)
What To Do: Same-sex couples can register their marriage at any district office (Amphur). The law provides the same rights as heterosexual marriages including inheritance, medical decisions, and tax benefits.
Right to protection from gender-based discrimination
Legal Basis: Gender Equality Act B.E. 2558 (2015), Section 17
What To Do: File a complaint with the Committee on Gender Equality Promotion if you experience discrimination based on gender identity or sexual orientation.
Right to equal treatment in employment
Legal Basis: Gender Equality Act B.E. 2558 (2015); Labour Protection Act B.E. 2541 (1998)
What To Do: Employers cannot discriminate in hiring, pay, or termination based on sexual orientation or gender identity. File with the Labour Inspector if violated.
Right to adopt children as a same-sex couple

What To Do: Transgender individuals can petition for title change. The process requires medical documentation and varies by district office.
Right to access healthcare without discrimination
Legal Basis: National Health Act B.E. 2550 (2007); Gender Equality Act B.E. 2558 (2015)
What To Do: Healthcare providers cannot refuse treatment based on sexual orientation or gender identity. Report violations to the Medical Council or Gender Equality Committee.
Common Myths vs Reality
Myth: Same-sex marriage is not legal in Thailand
Reality: Thailand passed the Marriage Equality Act in 2024, becoming the first Southeast Asian country to legalize same-sex marriage. It provides full legal equality.
Myth: LGBTQ+ people have no legal protections in Thailand
Reality: The Gender Equality Act B.E. 2558 (2015) prohibits discrimination based on gender expression and sexual orientation, and the Marriage Equality Act provides marriage rights.
Myth: Transgender people cannot change their legal gender
Reality: While full legal gender change on ID documents is still evolving, transgender persons can change their title prefix and the Gender Equality Act protects against discrimination.
