Overview
Thailand regulates cryptocurrencies and digital tokens under the Emergency Decree on Digital Asset Businesses B.E. 2561 (2018), supervised by the Securities and Exchange Commission (SEC). Businesses that operate a digital-asset exchange, or act as a broker or dealer, must be licensed and meet capital, custody, cybersecurity and customer-protection requirements, and comply with anti-money-laundering rules. Investors are protected by disclosure and suitability rules, and the SEC periodically restricts higher-risk activities (such as certain crypto lending, public staking services, and using crypto as a means of payment). Tax has its own regime: a time-limited personal income-tax exemption applies to capital gains realised through SEC-licensed operators from 1 January 2025 to 31 December 2029. This is a fast-moving area — confirm current SEC notifications before acting.
