Elements of the Offence
For a conviction, the prosecution must prove all of the following elements beyond reasonable doubt:
Property was lawfully entrusted to the accused
Relationship of trust existed (employment, agency, fiduciary)
Dishonest appropriation or conversion of the property
Intent to deprive the owner permanently
The property belonged to another person

Maximum Penalty
Up to 5 years imprisonment and/or fine up to 10,000 THB (up to 10 years if by a fiduciary)
Actual sentences depend on factors including the severity of the conduct, harm caused, prior convictions, and mitigating circumstances. Courts have discretion to impose lesser sentences within the statutory range.

Belief in right to use property in that manner
