    Competition & Antitrust

Thai competition law — abuse of dominance, cartels, merger control, and unfair trade practices.

    Overview

Competition in Thailand is governed by the Trade Competition Act B.E. 2560 (2017), enforced by the Office of Trade Competition Commission (OTCC). The Act prohibits the abuse of a dominant market position, anti-competitive agreements between competitors (cartels, including price-fixing and bid-rigging), and unfair trade practices, and it introduces merger control requiring notification of, or prior approval for, mergers that meet prescribed thresholds. State enterprises and certain regulated sectors have specific treatment. Breaches can carry administrative fines, criminal penalties for hard-core conduct, and civil liability to those harmed.
