Case Study: Cryptocurrency Fraud Recovery
A victim of cryptocurrency investment fraud in Thailand navigated criminal and civil proceedings to partially recover lost funds.
This case study is based on anonymized real-world situations and is presented for educational purposes only.
The Situation
An Australian expat living in Bangkok invested THB 5 million in what was presented as a cryptocurrency trading fund operated by a Thai-registered company. The company promised guaranteed returns of 10% per month. After receiving returns for 3 months, payments stopped and the company's website went offline. The expat discovered the company's SEC registration was fraudulent.
Legal Issues Involved
Fraud under Criminal Code Sections 341-344
Operating an unlicensed digital asset business (Emergency Decree on Digital Asset Business)
Anti-Money Laundering Act — proceeds of crime
Computer Crime Act — online fraud and false information
What Happened (Process)
- 1
Victim filed criminal complaint with Technology Crime Suppression Division (TCSD)
- 2
Simultaneous complaint filed with the SEC for operating without a license
- 3
AMLO notified to trace and potentially freeze assets
- 4
TCSD investigation identified the perpetrators and seized electronic devices
- 5
Arrest warrants issued for 3 Thai nationals and 1 foreign national
- 6
Civil lawsuit filed for recovery of invested funds
- 7
AMLO successfully froze THB 8 million in suspect bank accounts
- 8
Criminal prosecution proceeded alongside civil recovery
Outcome
Two of the four perpetrators were arrested and convicted of fraud, receiving prison sentences of 5 and 3 years respectively. AMLO forfeited THB 8 million in frozen assets, of which THB 2.5 million was eventually returned to the victim through civil proceedings. The total loss was THB 2.5 million (50% recovery). Two suspects remained at large.
Key Lessons
Never invest in unregistered digital asset businesses — check the SEC's licensed operator list.
Guaranteed returns are a red flag — no legitimate investment can guarantee returns.
File criminal complaints promptly — delays allow perpetrators to move assets.
AMLO asset freezing is a powerful tool but requires early engagement.
Recovery rates in crypto fraud are generally low — prevention is the best strategy.
