    Overview

    The Board of Investment (BOI / สำนักงานคณะกรรมการส่งเสริมการลงทุน, BOI) categorises promotable activities under the Investment Promotion Act B.E. 2520 (1977), in particular Sections 31 and 32 which govern corporate-income-tax exemptions and reductions. The current activity-based scheme groups projects into Groups A1, A2, A3 and A4 (high-value / technology-intensive) and Groups B1 and B2 (supporting industries and lighter-touch incentives). Each group carries a different maximum corporate-income-tax holiday and different non-tax privileges. Foreign investors must match their proposed project to the correct category to forecast incentives accurately and structure capital, technology transfer and Thai-employee plans accordingly.

    Groups A1-A4: High-Value Activities

    Group A captures the activities BOI most wants to attract. The higher the category, the deeper the technology component and the longer the corporate-income-tax exemption available under Section 31 of the Investment Promotion Act B.E. 2520 (1977).

    • A1: Biotechnology, advanced materials, nanotechnology R&D, software / digital content development with significant local R&D — 8 years CIT exemption, no cap
    • A2: Manufacture of medical devices, aircraft parts, robotics, renewable-energy generation — 8 years CIT exemption capped at investment value
    • A3: Manufacture of electric vehicles and components, smart electronics, automation systems — 5 years CIT exemption
    • A4: Manufacture of products from agricultural raw materials with value-add, certain food-processing activities — 3 years CIT exemption
    • All A-group projects: import duty exemption on machinery (Section 28) and on raw materials for export production (Section 36)

    Groups B1 and B2: Supporting Industries

    Group B projects are useful to Thailand's industrial ecosystem but use more mature technology. They receive non-tax incentives and import-duty relief but generally no CIT holiday, or only narrow ones.

    • B1: Manufacture of supporting parts such as moulds and dies, machine parts, packaging materials — machinery duty exemption and non-tax privileges
    • B2: Trading and service activities adjacent to promoted manufacturing — non-tax privileges only
    • Both B-group categories still permit 100% foreign ownership and override Foreign Business Act B.E. 2542 (1999) restrictions for the promoted activity

    Merit-Based Additional Incentives

    Layered on top of group-based incentives, BOI offers merit-based additional CIT exemption (up to 3 extra years, capped at 200% of qualifying expenses) for projects that invest in R&D, advanced technology licensing, Thai workforce upskilling, or location in less-developed provinces.

    • R&D spend at minimum 1-2% of revenue (or fixed THB thresholds) unlocks additional exemption years
    • Technology-transfer agreements with Thai universities or research institutes
    • Investment in vocational training and dual-system Thai-staff education
    • Location in 20 lowest-per-capita-income provinces under Section 32(3)

    Relevance for Foreign Nationals

    For foreign investors, the BOI category determines not just tax burden but also whether the project can be 100% foreign-owned, whether land can be held in the company name, and how many foreign experts can be sponsored for work permits. Map the proposed activity to the BOI activity list (current edition is the Activity-Based Investment Promotion list) before finalising capital structure or signing real-estate leases.
