    Overview

The bail system in Thailand operates differently from most Western countries. Understanding how bail works is crucial for anyone facing criminal charges or helping someone who has been arrested.

    Legal Framework

Bail in Thailand is governed by the Criminal Procedure Code B.E. 2477 (1934), Sections 106–119. The court has discretion to grant or deny bail based on several factors.

    Types of Bail

    #

    Cash Bail
  1. Most common form
  2. Amount set by the court based on severity of charge
  3. Cash is returned (minus court fees) upon case completion
  4. Can range from 50,000 THB for minor offences to millions for serious charges

    #

    Property Bail

  5. Government bonds or titled property used as surety
  6. Property value must exceed bail amount
  7. Title deed held by the court during proceedings

    #

    Personal Guarantee

  8. A person of standing (often a lawyer) guarantees the accused's appearance
  9. Less common for serious offences

    Bail Amounts by Offence Type

    - Minor offences: 50,000–200,000 THB

  10. Moderate offences: 200,000–500,000 THB
  11. Serious offences (drugs, fraud): 500,000–2,000,000 THB
  12. Capital offences: Often denied or set at 1,000,000+ THB

    Conditions of Bail

    - Surrender passport (common for foreigners)

  13. Report to police station or court at regular intervals
  14. Travel restrictions (often cannot leave Thailand)
  15. No contact with victims or witnesses
  16. Electronic monitoring in some cases

    When Bail May Be Denied

    - Risk of flight (especially for foreigners)

  17. Risk of evidence tampering
  18. Risk of harm to victims or witnesses
  19. Serious charges (capital offences, major drug trafficking)
  20. History of bail violations

    Foreigner-Specific Issues

    - Flight-risk concerns commonly weigh against bail for foreign defendants

  21. Passport surrender is typically required as a bail condition
  22. Embassy assistance may be available for bail applications (varies by country)
  23. A Thai guarantor (employer, spouse) is often a factor courts consider
  24. Bail decisions remain at judicial discretion under CPC §106; outcomes vary by court, judge, charge, and facts. This page is general information, not a prediction of outcomes — for a specific case, contact a Thai-qualified lawyer
