Personal Guarantor Agreement
Agreement where a third party guarantees payment or performance of another's obligation — common for rental leases and business loans.
When to Use
When a landlord, lender, or business partner requires a personal guarantor for a lease, loan, or contract.
Key Clauses
Identification of Parties
Principal debtor, creditor, and guarantor. Full legal names, ID numbers.
Guaranteed Obligation
Specific obligation being guaranteed — maximum amount, specific contract reference.
Guarantee Limit
Maximum amount the guarantor is liable for. ALWAYS set a cap.
Duration of Guarantee
Start and end date. Guarantees should not be open-ended.
Notice Requirements
Creditor must notify guarantor before demanding payment. Guarantor has right to cure.
Right of Subrogation
After paying, guarantor has the right to recover from the principal debtor.
Warnings
NEVER sign an unlimited guarantee — always cap the amount and duration.
Guarantors are personally liable for the full guaranteed amount — assets can be seized.
Thai law requires guarantee agreements to be in writing to be enforceable.
