Domestic Helper / Household Employee Contract

When to Use
When hiring a domestic helper, housekeeper, nanny, cook, or other household employee in Thailand. Applies to both Thai and foreign domestic workers (foreign workers also need a valid work permit).

Job Description & Duties
Specific duties such as cleaning, cooking, childcare, laundry, gardening, and driving. Clearly define scope to avoid disputes.
Working Hours & Rest Days
Daily working hours (max 8 hours/day, 48 hours/week), overtime terms, and guaranteed rest days (minimum 1 day/week, plus public holidays).
Salary & Payment Schedule
Monthly salary amount (must meet minimum wage), payment date, payment method (cash/bank transfer), and any deductions. Overtime rate: 1.5x for weekdays, 3x for holidays.
Social Security Registration
Employer must register with Social Security Office within 30 days of hiring. Both parties contribute 5% of salary. Covers healthcare, disability, maternity, and old-age pension.
Probation Period
Maximum 119 days. During probation, employer may terminate without severance but must still provide advance notice (1 pay cycle). State evaluation criteria.
Termination Notice & Severance Pay
Minimum 1 pay cycle advance notice. Severance pay based on length of service (30-400 days' wages depending on tenure per Labour Protection Act).
Confidentiality & Privacy
Employee agrees not to disclose employer's personal information, household matters, or security arrangements to third parties.
House Rules & Conduct
Rules regarding visitors, phone use during work hours, dress code, handling of household items, and overnight stays (for live-in helpers).
Accommodation & Meals (Live-in)
If live-in, specify room arrangements, meals provided, utility access, and conditions for personal time and privacy.
Signatures & Witnesses
Both parties sign with date. Two witnesses recommended. Bilingual version (Thai + English) advised if either party is a foreigner.
Warnings
Thai labour law overrides any contract terms that provide less than statutory minimums — you cannot contract out of minimum wage, rest days, or severance.
Domestic helpers are fully covered by the Labour Protection Act — there is no exemption for household workers.
Failure to register with Social Security within 30 days is an offence punishable by fine.
Live-in helpers must still have defined working hours — 24-hour on-call arrangements are not legal.
For foreign domestic helpers, ensure the work permit specifically covers domestic work — violations carry penalties for both employer and employee.
