When to Use
When a consumer in Thailand (Thai or foreign) has been harmed by defective products, misleading advertising, unfair contract terms, or deceptive business practices and seeks redress through the OCPB.
Key Clauses
Complainant Information
Full name, address, phone number, email, and ID/passport number of the consumer filing the complaint.
Business/Seller Information
Name and address of the business, store location, website, and any registration numbers or tax IDs.
Product/Service Description
Detailed description of the product or service purchased, including date, price, receipt number, and payment method.
Description of Complaint
Clear, chronological account of the problem: what was promised, what was delivered, how it is defective or misleading.
Evidence Attachments
Copies of receipts, contracts, advertisements, photographs of defective products, correspondence with the seller.
Previous Resolution Attempts
Record of attempts to resolve directly with the seller: dates of contact, responses received, refund requests.
Requested Remedy
Specific remedy sought: refund, replacement, repair, compensation for damages, or contract cancellation.
Warnings
The OCPB handles complaints free of charge — you do not need a lawyer to file.
Keep original receipts and evidence; submit copies with your complaint and retain originals.
OCPB can order mediation, but enforcement of compensation requires a court order if the business refuses to comply.
The statute of limitations for consumer complaints is generally 1 year from discovery of the defect or harm.
Online purchases from overseas sellers may be difficult to enforce — OCPB jurisdiction is limited to businesses operating in Thailand.
